Terms & Conditions

Effective Date: September 2, 2026

These Terms of Use (“Terms“) govern your access to and use of websites, web applications, mobile applications, and other services operated by ZenBinary (“ZenBinary,” “we,” “us,” or “our“).

These Services include ZenBinary.com, PicPlayer, BandBeats, and other current or future ZenBinary products and applications (collectively, the “Services“).

By accessing or using a Service, you agree to these Terms. If you do not agree to them, do not use the Services.

1. Our Services

ZenBinary creates software and digital tools intended to make creative activities more accessible.

Our Services may include tools for editing photographs and images, creating or editing music and audio, playing media, producing creative projects, and other functionality we may introduce.

Some Services are offered free of charge. We may introduce optional paid functionality, subscriptions, advertisements, or other business models in the future. If we do, applicable pricing and additional terms will be presented before you make a purchase.

2. Eligibility

You must be legally capable of agreeing to these Terms under the laws applicable to you.

If you are not legally able to enter into these Terms yourself, your parent, legal guardian, or another authorized person must agree on your behalf where permitted by law.

3. Permission to Use the Services

Subject to these Terms, ZenBinary gives you a limited, personal, non-exclusive, non-transferable, revocable right to access and use the Services for lawful purposes.

This permission does not transfer ownership of the Services or any ZenBinary intellectual property to you.

For mobile applications downloaded through an app marketplace, your use of the application may also be subject to the marketplace’s applicable terms and end-user license agreement.

4. Your Content

You retain ownership of the photographs, images, audio recordings, music, files, projects, text, and other content that you create or provide through the Services (“User Content“), subject to any rights belonging to third parties.

ZenBinary does not obtain ownership of your User Content simply because you use our Services.

If you upload User Content to ZenBinary servers, you give us a limited, non-exclusive permission to host, copy, process, transmit, modify, and otherwise handle that content only to the extent reasonably necessary to provide, maintain, secure, and improve the feature you requested.

This permission ends when the relevant content is deleted from our systems, except for temporary backups, legal retention requirements, or other circumstances permitted by applicable law.

5. Your Responsibility for Content

You are responsible for the User Content you import, edit, create, upload, export, distribute, or share using the Services.

You represent that you have the rights and permissions necessary to use that content and that your use of the Services does not violate another person’s copyright, trademark, privacy, publicity, contractual, or other legal rights.

ZenBinary providing an editing or creation tool does not grant you rights to copyrighted photographs, music, recordings, artwork, trademarks, or other third-party materials.

6. Acceptable Use

You may not use the Services to break applicable laws; infringe intellectual-property or privacy rights; distribute malware or malicious code; attempt to gain unauthorized access to our systems; interfere with or overload the Services; circumvent security or usage restrictions; scrape or automatically access the Services in a manner that materially burdens our infrastructure; impersonate another person; engage in fraud; or use the Services to harm other users or third parties.

You also may not copy, sell, sublicense, reverse engineer, decompile, or attempt to extract source code from proprietary portions of the Services except where such restrictions are prohibited by law or an applicable open-source license.

7. ZenBinary Intellectual Property

The Services, including their software, source code, interfaces, design, branding, logos, graphics, text, and other ZenBinary-provided materials, are owned by ZenBinary or our licensors and are protected by applicable intellectual-property laws.

“ZenBinary,” “PicPlayer,” “BandBeats,” and associated names, logos, and branding may be trademarks or other protected identifiers belonging to ZenBinary.

Nothing in these Terms gives you permission to use ZenBinary branding except as necessary to identify the Services in a lawful manner.

8. Open-Source and Third-Party Software

Parts of the Services may contain open-source or third-party software.

Such software may be governed by separate license terms. Where an applicable open-source license conflicts with these Terms regarding that particular software, the open-source license controls.

9. App Stores and Platform Providers

Mobile versions of the Services may be distributed through third-party platforms such as Apple’s App Store.

Your use of those platforms is also subject to their terms, policies, purchase rules, and licensing arrangements.

Unless ZenBinary provides a custom end-user license agreement for a particular Apple application, Apple’s standard EULA may apply to the licensed mobile application. Apple confirms that its standard EULA applies when a developer does not provide a custom one.

Apple and other platform providers are not responsible for ZenBinary’s websites or web-based Services merely because a ZenBinary mobile application is distributed through their platform.

10. Feedback

If you voluntarily send us ideas, suggestions, bug reports, or other feedback about our Services, you allow ZenBinary to use that feedback without restriction or compensation to you.

This does not transfer ownership of your unrelated creative works or User Content to ZenBinary.

11. Availability and Changes to the Services

We may add, modify, suspend, discontinue, or replace features of the Services from time to time.

We do not guarantee that every feature will always remain available, that a particular application will continue to support every operating system or device, or that files created with a Service will remain compatible indefinitely.

Where reasonable, we will try to avoid unnecessarily disrupting users.

You are responsible for keeping appropriate backups of important creative projects and exported files.

12. Beta and Experimental Features

We may make beta, preview, or experimental features available.

Such features may contain bugs, change substantially, produce unexpected results, or be discontinued without notice. You should not rely on beta functionality for critical or irreplaceable work.

13. Third-Party Services

Some Services may interact with third-party libraries, websites, cloud services, operating-system functionality, or app marketplaces.

We are not responsible for independent third-party services, and their use may be governed by separate terms and privacy policies.

14. Copyright and Intellectual-Property Complaints

If you believe content hosted by ZenBinary infringes your copyright or other intellectual-property rights, contact us at [legal@zenbinary.com or another monitored email] with sufficient information for us to identify the content and understand your claim.

We may remove or restrict access to allegedly infringing material where appropriate.

15. Termination

You may stop using the Services at any time.

We may suspend or terminate access to a Service if you materially violate these Terms, create security or legal risk, abuse the Service, or where suspension or termination is otherwise reasonably necessary to protect ZenBinary, our users, or third parties.

Provisions that by their nature should continue after termination—including intellectual-property provisions, disclaimers, limitations of liability, and dispute provisions—will survive.

16. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available.”

ZenBinary does not guarantee that the Services will always be uninterrupted, error-free, secure, or compatible with every device, browser, file format, photograph, audio file, or operating system.

Creative and media-processing software may occasionally produce unexpected output, compatibility issues, or data loss. You should maintain backups of files that are important to you.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

17. Limitation of Liability

To the maximum extent permitted by applicable law, ZenBinary and its owners, officers, employees, contractors, affiliates, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, data, files, or creative projects arising from or relating to the Services.

Where liability cannot legally be excluded, ZenBinary’s liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms limits liability where doing so would be unlawful, including any liability that applicable consumer law does not permit us to exclude.

18. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold ZenBinary harmless from third-party claims, liabilities, damages, and reasonable expenses arising from your unlawful use of the Services, your User Content, or your material violation of these Terms.

This section does not apply to the extent prohibited by applicable consumer law.

19. Governing Law

These Terms are governed by the laws of [country/state where ZenBinary’s legal operator is established], without regard to conflict-of-law rules.

Any mandatory rights you have under the consumer laws of the country where you live remain unaffected.

Any dispute that cannot be resolved informally will be handled by the courts or other dispute-resolution forum having jurisdiction under applicable law.

This section should be finalized based on the country in which ZenBinary or its owner/company is legally established.

20. Changes to These Terms

We may update these Terms to reflect changes to our Services, legal requirements, security needs, or business practices.

We will update the effective date when the Terms change. Where required by law, we will give users additional notice before material changes become effective.

21. Entire Agreement

These Terms, together with any additional terms expressly applicable to a particular ZenBinary Service, form the agreement between you and ZenBinary concerning use of the Services.

If any provision is found unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
